This End-User License Agreement ("EULA") is a legal agreement between you and MCM Wellness Office governing your use of the MCM Touch iOS application. By downloading or using the app, you agree to the terms of this EULA. If you do not agree, do not download or use the app.
1. License Grant
MCM Wellness Office grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the MCM Touch iOS application (the "App") on any Apple-branded device that you own or control, solely for your personal, non-commercial wellness purposes in accordance with this EULA and Apple's Usage Rules as set forth in the App Store Terms of Service.
2. Licence Restrictions
You may not:
- Copy, modify, or create derivative works of the App or any part of it.
- Reverse engineer, disassemble, decompile, or attempt to derive the source code of the App, except as permitted by applicable law.
- Sell, sublicense, rent, lease, lend, redistribute, or otherwise transfer the App or any rights in it to any third party.
- Remove, obscure, or alter any proprietary notices, labels, or marks on the App.
- Use the App for any commercial purpose or for any public display (commercial or non-commercial).
- Use the App in any way that violates applicable local, national, or international law or regulation.
- Use the App to transmit unsolicited messages, malware, or any content that infringes on the rights of others.
3. Intellectual Property
The App, including all content, features, design, trademarks, trade names, service marks, logos, and software, is owned by MCM Wellness Office or its licensors and is protected by intellectual property laws of the Republic of the Philippines and applicable international treaties.
This EULA does not convey any ownership interest in the App. All rights not expressly granted are reserved by MCM Wellness Office.
4. Apple-Specific Terms
This EULA is an agreement between you and MCM Wellness Office, not with Apple Inc. Apple is not responsible for the App and its content.
- Maintenance and Support: MCM Wellness Office, not Apple, is solely responsible for providing maintenance and support services for the App.
- Warranty: MCM Wellness Office, not Apple, is solely responsible for any product warranties. Apple has no warranty obligation whatsoever with respect to the App.
- Product Claims: MCM Wellness Office, not Apple, is responsible for addressing any claims by you or any third party relating to the App.
- Third-Party IP Claims: In the event of any third-party intellectual property infringement claim, MCM Wellness Office, not Apple, is solely responsible for investigation, defence, settlement, and discharge.
- Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
5. Updates & Changes
- MCM Wellness Office may, from time to time, release updates to the App via the App Store. Updates may be required to continue using certain features.
- We may modify this EULA at any time. The updated EULA will be posted at mcmtouch.com/eula.html and, where material, you will be notified within the App.
- Continued use of the App after an EULA update constitutes acceptance of the revised terms.
6. Termination
- This EULA is effective until terminated.
- Your rights under this EULA terminate automatically without notice if you fail to comply with any of its terms.
- You may terminate this EULA at any time by deleting the App from your device and deleting your account from within the App.
- Upon termination, you must cease all use of the App and destroy all copies in your possession.
- Sections 3, 7, and 8 of this EULA shall survive any termination.
7. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, to the fullest extent permitted by Philippine law. MCM Wellness Office does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
MCM Touch is not a medical device. Content within the App is for wellness information purposes only and does not constitute medical advice, diagnosis, or treatment.
8. Limitation of Liability
To the maximum extent permitted by applicable Philippine law, MCM Wellness Office shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from:
- Your use of or inability to use the App.
- Any health decisions made based on content within the App.
- Unauthorised access to or alteration of your data.
- Any interruption or cessation of the App's functionality.
