1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and MCM Wellness Office ("MCM Touch", "we", "us", or "our"), a wellness practice operating under the laws of the Republic of the Philippines.

By registering for an account, downloading the MCM Touch iOS application, or accessing the MCM Touch web application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. User Accounts

• You must be at least 13 years of age to create an account. Users under 18 must have parental or guardian consent.
• You are responsible for maintaining the confidentiality of your account credentials. You must not share your password with any third party.
• You must provide accurate, current, and complete information during registration and keep your profile up to date.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@mcmtouch.com if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Consultation Bookings

• Consultation bookings are subject to practitioner availability. Availability is updated in real time and is not guaranteed until confirmed by MCM Wellness staff.
• A booking confirmation will be sent via push notification or in-app message once approved.
• You may cancel or reschedule a pending booking through the app. Cancellations of confirmed bookings must be made at least 24 hours in advance.
• Late cancellations or no-shows may affect your ability to book future consultations at MCM's discretion.
• Calendar sync to your native iOS Calendar via EventKit is an optional feature and requires your explicit permission.

4. Natural Products Shop

• All product listings, descriptions, and prices are provided for informational purposes. Prices are displayed in Philippine Peso (₱) and are subject to change without notice.
• Product orders placed through the app are subject to availability. MCM Touch reserves the right to cancel any order if a product becomes unavailable.
• Payment processing is handled separately. Placing an order in the app does not constitute a completed purchase until payment is confirmed and the order status is updated.
• Natural and herbal products are not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before use.
• Refund and return policies are governed by MCM Wellness Office's in-store policy and applicable Philippine consumer protection laws.

5. Health Talk Content & Media Library

• Videos and articles in the Health Talk Library are provided for general wellness education purposes only.
• Content does not constitute professional medical advice, diagnosis, or treatment.
• Always seek the advice of a qualified physician or other qualified health provider with any questions you may have regarding a medical condition.
• MCM Touch is not responsible for any health decisions made based on content in the library.

6. Health Metrics Tracker

• The Health Tracker is a personal wellness logging tool for your own reference. Data you enter is stored securely under your account.
• Logged data does not constitute a medical record and should not be used as a substitute for professional medical evaluation.
• MCM Touch staff may view your health log summaries solely for the purpose of providing you with personalised wellness guidance during consultations, with your consent.

7. Secure Messaging

• The in-app messaging channel is intended for wellness-related communications between you and your assigned MCM Touch practitioner.
• Messages must not be used for emergencies. For medical emergencies, contact emergency services (911 in the Philippines) immediately.
• You must not use the messaging channel to send harmful, offensive, threatening, or unlawful content.
• MCM Touch staff may review messages to ensure quality of care and compliance with these Terms.

8. Prohibited Conduct

You agree not to:

• Use the app for any unlawful purpose or in violation of Philippine law.
• Attempt to gain unauthorised access to any part of the app or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the application.
• Upload, post, or transmit malicious code, viruses, or any content that is defamatory, obscene, or infringes on any third party's intellectual property rights.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use any automated system, bot, or scraper to access the app or its content.
• Interfere with or disrupt the integrity or performance of the app or its services.

9. Intellectual Property

All content, trademarks, logos, graphics, and software included in MCM Touch — including the MCMtouch brand, design system, and source code — are the exclusive property of MCM Wellness Office or its licensors and are protected by applicable intellectual property laws of the Republic of the Philippines.

You are granted a limited, non-exclusive, non-transferable licence to use the app for its intended personal wellness purposes. You may not copy, modify, distribute, or create derivative works from any part of MCM Touch without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by Philippine law, MCM Wellness Office shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the app.
• Any health outcomes resulting from reliance on content, products, or practitioner communications facilitated through the app.
• Any loss of data, loss of revenue, or business interruption.
• Any third-party actions, including but not limited to payment processors or service providers.

11. Termination

• You may delete your account at any time from within the app (Profile → Delete Account). This permanently deletes your data from our systems.
• We reserve the right to suspend or terminate your access immediately and without notice if you violate these Terms.
• Upon termination, your right to use the app ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall survive.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the appropriate courts of the Philippines with proper jurisdiction.
